《天津市高层建筑消防安全管理规定》已于2022129日经市人民政府第211次常务会议通过,现予公布,自202321日起施行。

Provisions of TianjinFire Safety Managementof High-rise Buildings, adopted at the 211th executive meeting of the Municipal People’s Government on December 9, 2022, is hereby promulgated and shall enter into effect as of February 1, 2023.

Provisions of Tianjin Fire Safety Management of High-rise Buildings


第一章总则

Chapter I General Provisions


第一条为了加强高层建筑消防安全管理,预防火灾和减少火灾危害,保护人身、财产安全,维护公共安全,根据《中华人民共和国消防法》、《天津市消防条例》等法律、法规,结合本市实际,制定本规定。

Article 1These Provisions are formulated for the purposes of strengthen the fire safety management of high-rise buildings, preventing fire disasters, reducing fire damages, protecting the human and property safety and maintainingthe public safety, in accordance with the Fire Prevention Law of the People’s Republic of China, FireRegulations of Tianjin Municipality and other laws and regulations, in consideration of the actual situation of this Municipality.


第二条本规定适用于本市行政区域内已经建成且依法投入使用的高层建筑(包括高层住宅建筑和高层公共建筑)的消防安全管理。

Article 2These Provisions apply to the fire safety management of the high-rise buildings in the administrative regions of this Municipality (including the high-rise residential buildings and high-rise public buildings) that have been built and put into use legally.


第三条高层建筑消防工作贯彻预防为主、防消结合的方针,按照政府统一领导、部门依法监管、单位全面负责、公民积极参与的原则,落实消防安全责任制,立足自防自救,实行科学管理。

建筑高度超过100米的高层建筑应当实行更加严格的消防安全管理。

Article3 In the fire protection work of high-rise buildings, the policy of focusing on prevention and combining prevention with firefighting shall be observed, the principle of uniform governmental leadership, departmental supervision according to law, overall responsibilities of entities and active participation of citizens shall be followed, a safety accountability system for fire prevention shall be adopted, and scientific management shall be conducted based on self-protection and self-rescue.

Stricter fire safety management must be exercised for the high-rise buildings with a height of more than 100 meters.


第二章消防安全职责

Chapter II Fire Safety Duties


第四条市和区人民政府应当加强本行政区域内的高层建筑消防工作,督促所属部门和下级人民政府落实消防安全责任制,协调解决高层建筑消防工作重大问题,保障消防救援力量、公共消防基础设施、灭火救援设施等建设与高层建筑消防救援需求相匹配。

乡镇人民政府、街道办事处应当落实高层建筑消防安全网格化管理责任,指导、支持和帮助村民委员会、居民委员会开展群众性的消防工作。

Article 4 The municipal and district people’s governments shall strengthen the fire protection work for high-rise buildings within their administrative areas, urge their subordinate departments and people’s governments at lower levels to implement a fire safety accountability system, coordinate to solve major problems in the fire protection workof high-rise buildings, and ensure that the fire fighting and rescue forces, public fire protection infrastructures, fire fighting and rescue facilities, etc. match the fire fighting and rescue needs of high-rise buildings.

The township(town) peoples governmentsorurban sub-district administrative offices shall implement the grid-based management responsibility of fire safety in high-rise buildings, and guide, support and assistvillagers’ committeesorresidents’ committees in carrying out the mass fire protection work.


第五条应急管理部门对本行政区域内的高层建筑消防工作实施监督管理,并由本级消防救援机构负责实施。

市和区人民政府其他有关部门按照管行业必须管安全、管业务必须管安全、管生产经营必须管安全的要求,在各自职责范围内依法依规做好本行业、本领域的高层建筑消防安全工作。

Article 5 The emergency management authority shall supervise and administer the fire protection work for high-rise buildings within the administrative area, and the fire and rescue departmentat the same level shall be responsible for carrying out the fire protection work.

Other departments of the municipal and district people’s governments shall, in accordance with the requirementsthat industry management and safety, business and safety, production and safety must be managed at the same time, do a good job in the fire protection safety for high-rise buildings in their respective industries and fields under laws and regulations.


第六条消防救援机构应当指导和督促机关、团体、企业、事业等单位落实消防安全责任制,制定高层建筑灭火应急救援预案并开展演练,提高火灾扑救和应急救援的能力。

消防救援机构应当定期对本行政区域内的高层建筑进行消防安全综合评估,并根据评估提出改进措施和建议报送本级人民政府。接到报告的人民政府应当协调、指导、督促解决高层建筑消防安全重大问题。

Article 6 The fire and rescue department shall provide guidance and urge organs, social groups, enterprises, public institutions and other entities to implementafire safety accountability system, work out a firefighting and emergency evacuation preparedness plan for high-rise buildings, and organize drillings to improve the capabilities of firefighting and emergency response and rescue.

The fire and rescue department shall regularly conduct comprehensive fire safety assessment of high-rise buildings within its administrative area, put forward improved measures and suggestions and submit them to the people’s government at the same level according to the assessment. The people’s government receiving the report shall coordinate, direct and urge to solve the major fire safety problems of high-rise buildings.


第七条规划资源部门审批建筑高度80米以上高层住宅建筑、100米以上高层公共建筑建设项目时,应当征求同级消防救援机构意见,确保与消防救援能力相匹配。

Article 7When approving the construction projects of high-rise residential buildings over 80 meters in height and high-rise public buildings over 100 meters in height, the planning and resources department should seek the opinions of the fire rescue department at the corresponding level to ensure that those buildings are in line with the fire rescue capabilities.


第八条市住房城乡建设部门对确需新建的超高层建筑进行审查并报送备案。

住房城乡建设部门根据国家和本市规定,指导、督促物业服务企业按照法律、法规、规章规定和合同约定做好高层住宅建筑共用消防设施的维护管理工作,督促物业服务企业依法依约开展高层建筑消防安全管理服务工作。

Article 8 The municipal housing and urban-rural development authority shall review and report on the construction of super high-rise buildings that are deemed necessary and submit them for record-keeping.

According to the regulations of the state and this Municipality, the housing and urban-rural development authoritydirects and urges the realty service enterprise to do a good job in the maintenance and management of common fire protection facilities in high-rise residential buildings in accordance with laws, regulations, rules and contracts, and urges the realty service enterprises to carry out fire-fighting safety management services in high-rise buildings in accordance with the law.


第九条城市管理部门审批的高层建筑户外广告设施设置,应当符合相关安全技术规范、标准,户外广告设施不得妨碍安全疏散、灭火救援、建筑防排烟。

Article 9 Outdoor advertising facilities for high-rise buildings approved by the urban management department shall comply with relevant safety technical specifications and standards. These outdoor advertising facilities must not obstruct safety evacuation, firefighting and rescue operations, or building smoke extraction.


第十条高层建筑所在社区居民委员会、村民委员会应当履行消防安全责任制规定的消防安全职责;对老年人、未成年人、残疾人等开展有针对性的消防安全宣传教育,加强消防安全帮扶。

Article 10 The residents’ committees and villagers’ committeesof the communities where high-rise buildings are located should fulfill their fire safety responsibilities as stipulated in the fire safety accountability system. They should conduct targeted fire safety awareness campaigns for elderly people, minors, disabled individuals, and other vulnerable groups, while also providing assistance and support in enhancing fire safety measures.


第十一条高层建筑的业主、使用人是高层建筑消防安全责任主体,依法对高层建筑的消防安全负责。高层建筑的业主、使用人是单位的,其法定代表人或者主要负责人是本单位的消防安全责任人。

高层建筑的业主、使用人可以委托物业服务企业或者消防技术服务机构等专业服务单位(以下统称消防服务单位)提供消防安全服务,并应当在服务合同中约定消防安全服务的具体内容。

Article 11The owners and users of high-rise buildings are the primary entities responsible for fire safety in high-rise buildings, and are legally responsible for the fire safety of high-rise buildings. If the owners and users are entities, their legal representative or the main person in charge is the one responsible for fire safety within the entity.

The owners and users of high-rise buildings can entrust realty service enterprises or fire protection technology service organizations (hereinafter referred to as fire service units) to provide fire safety services, and should specify the specific content of fire safety services in the service contract.


第十二条同一高层建筑有两个及以上业主、使用人的,各业主、使用人对其专有部分的消防安全负责,对共有部分的消防安全共同负责。

同一高层建筑有两个及以上业主、使用人的,应当共同委托物业服务企业,或者明确一个业主、使用人作为统一管理人,对共有部分的消防安全实行统一管理,协调、指导业主、使用人共同做好整栋建筑的消防安全工作,并通过书面形式约定各方消防安全责任。

Article 12If a high-rise building has two or more owners or users, each owner or user is responsible for the fire safety of their exclusive parts, and jointly responsible for the fire safety of the shared parts.

If a high-rise building has two or more owners or users, they should jointly entrust a realty service enterprise, or designate one owner or user as the unified manager, to implement unified management of the fire safety for the shared parts. The unified manager should coordinate and guide the owners and users to jointly ensure the fire safety of the entire building, and agree on the fire safety responsibilities of all parties in writing.


第十三条高层建筑以承包、租赁或者委托经营、管理等形式交由承包人、承租人、经营管理人使用的,当事人在订立承包、租赁、委托管理等合同时,应当明确各方消防安全责任。委托方、出租方依照法律规定,可以对承包方、承租方、受托方的消防安全工作统一协调、管理。

实行承包、租赁或者委托经营、管理时,业主应当提供符合消防安全要求的建筑物,督促使用人加强消防安全管理。

Article 13When a high-rise building is handed over to a contractor, tenant, or manager for use via forms such as contracting, leasing, or entrusted management, the parties should specify each party's fire safety responsibilities when entering into contracts such as contracting, leasing, or entrusted management. The entrusting party or the lessor, in accordance with laws, can coordinate and manage the fire safety work of the contractor, tenant, or trustee.

Whenimplementing contracting, leasing, or entrusted management, the owner should provide a building that meets fire safety requirements and urge the user to enhance fire safety management.


第十四条高层公共建筑的业主单位、使用单位应当履行下列消防安全职责:

(一)遵守消防法律法规规章,建立和落实消防安全管理制度;

(二)明确消防安全管理机构或者消防安全管理人员;

(三)组织开展防火巡查、检查,及时消除火灾隐患;

(四)确保疏散通道、安全出口、消防车通道畅通;

(五)对建筑消防设施、器材定期进行检验、维修,确保完好有效;

(六)组织消防宣传教育培训,制定灭火和应急疏散预案,定期组织消防演练;

(七)按照规定建立专职消防队、志愿消防队(微型消防站)等消防组织;

(八)法律、法规、规章规定的其他消防安全职责。

委托物业服务企业,或者明确统一管理人实施消防安全管理的,物业服务企业或者统一管理人应当按照约定履行前款规定的消防安全职责,业主单位、使用单位应当督促并配合物业服务企业或者统一管理人做好消防安全工作。

Article 14 The owners and users of high-rise public buildings shall perform the following fire safety duties:

(1)to abide by the laws, regulations, rules on fire protection, establish and implement the fire safety management system;

(2)to specify fire safety management organizations or fire safety management personnel;

(3)to organize and carry out fire prevention patrols and inspections so as to eliminate potential fire risks;

(4)to ensure that the evacuation passages, safety exits and fire truck passages are clear;

(5)to conduct regular testing and maintenance of thefire protection facilitiesand apparatuses in a buildingso as to ensure that they are in good condition and effective;

(6)to organize the fire protection publicity, education and training, work out a firefighting and emergency evacuation preparedness plan, and organize regular fire protectiondrilling;

(7)to form full-time fire brigades, volunteer fire brigades (micro-sized fire stations) and other fire protection organizationsunder the provisions; or

(8)to perform other fire safety duties as prescribed by laws, regulations and rules.

The realty service enterprise or the unified manager entrusted to implementfire safety management shall perform the fire safety duties specified in the preceding paragraph as agreed, and the ownerentity and userentity shall urge and cooperate with the realty service enterprise or the unified manager to do a good job infire safety.


第十五条高层公共建筑的业主、使用人、物业服务企业或者统一管理人应当明确专人担任消防安全管理人,负责整栋建筑的消防安全管理工作,并在建筑显著位置公示其姓名、联系方式和消防安全管理职责。

高层公共建筑的消防安全管理人应当履行下列消防安全管理职责:

(一)拟订年度消防工作计划,组织实施日常消防安全管理工作;

(二)组织开展防火检查、巡查和火灾隐患整改工作;

(三)组织实施对建筑共用消防设施设备的维护保养;

(四)管理专职消防队、志愿消防队(微型消防站)等消防组织;

(五)组织开展消防安全的宣传教育和培训;

(六)组织编制灭火和应急疏散综合预案并开展演练。

高层公共建筑的消防安全管理人应当具备与其职责相适应的消防安全知识和管理能力。对建筑高度超过100米的高层公共建筑,鼓励有关单位聘用相应级别的注册消防工程师或者相关工程类中级及以上专业技术职务的人员担任消防安全管理人。

Article 15 The owners, users, realty service enterprises or unified managers of high-rise public buildingsshould designate a dedicated person to be the fire safety manager, responsible for the fire safety management of the entire building, and publicly display their name, contact information, and fire safety management responsibilities in a conspicuous position of the building.

The fire safety managers of high-rise public buildings shall perform the following fire safety management duties:

(1)to draw up an annual fire protection work plan and organize the implementation of daily fire safety management;

(2)to organize fire prevention inspections, patrol and elimination of potential fire risks;

(3)to organize the maintenance of shared fire safety facilities and equipment in the building;

(4)to manage full-time fire brigades, volunteer fire brigades (micro-sized fire stations) and other fire protection organizations;

(5)to organize fire safety publicity, education, and training;

(6)to organize the preparation of comprehensive firefighting and emergency evacuation plans and conduct drills;

The fire safety managers of high-rise public buildings should possess fire safety knowledge and management skills commensurate with their responsibilities. For high-rise public buildings with a building height of more than 100 meters, relevant entities are encouraged to employ certified fire engineers of corresponding levels or personnel with intermediate or higher professional technical positions in related engineering fields to serve as fire safety managers.


第十六条高层住宅建筑的业主、使用人应当履行下列消防安全义务:

(一)遵守住宅小区防火安全公约和管理规约约定的消防安全事项;

(二)按照不动产权属证书载明的用途使用建筑;

(三)配合消防服务单位做好消防安全工作;

(四)按照法律规定承担消防服务费用以及建筑消防设施维修、更新和改造的相关费用;

(五)维护消防安全,保护消防设施,预防火灾,报告火警,成年人参加有组织的灭火工作;

(六)法律、法规、规章规定的其他消防安全义务。

Article 16 The owners and users of high-rise residential buildings shall performs the following fire safety obligations:

(1)to abide byfire safety matters agreed in the residential community fire prevention convention and management agreement;

(2)to use the building according to the purpose stated in the real estate ownership certificate;

(3)to cooperate with the fire service entities to ensure fire safety;

(4)to assume the cost of fire service fees and the related costs of maintaining, updating, and retrofitting building fire facilities as stipulated by law;

(5)to maintain fire safety, protect fire facilities, prevent fires, report fire alarms, and participate in organized firefighting work as an adult;

(6)to perform other fire safety obligations stipulated by laws, regulations, and rules.


第十七条接受委托的高层住宅建筑的物业服务企业应当依法履行下列消防安全职责:

(一)落实消防安全责任,制定消防安全制度,拟订年度消防安全工作计划和组织保障方案;

(二)明确具体部门或者人员负责消防安全管理工作;

(三)对管理区域内的共用消防设施、器材和消防标志定期进行检测、维护保养,确保完好有效;

(四)组织开展防火巡查、检查,及时消除火灾隐患;

(五)保障疏散通道、安全出口、消防车通道畅通,对占用、堵塞、封闭疏散通道、安全出口、消防车通道等违规行为予以制止;制止无效的,及时报告消防救援机构等有关行政管理部门依法处理;

(六)督促业主、使用人履行消防安全义务;

(七)定期向所在住宅小区业主委员会和业主、使用人通报消防安全情况,提示消防安全风险;

(八)组织开展经常性的消防宣传教育;

(九)制定灭火和应急疏散预案,并定期组织演练;

(十)法律、法规、规章规定和合同约定的其他消防安全职责。

Article 17 The realty service enterprise of the entrusted high-rise residential buildinghall perform the following fire safety management duties according to law:

(1)to implementthe fire safety responsibilities,formulate fire safety systems, prepare annual plans for fire safety control and organizational guarantee schemes;

(2)to specify specific departments or personnel responsible for fire safety management;

(3)to inspect regularly, maintain, and ensure the effectiveness of the shared fire facilities, equipment, and firefighting signs in the management area;

(4)to organize fire prevention patrol and inspections so as to eliminate potential fire risks;

(5)To ensure the evacuation routes, safety exits, and fire truck access are unobstructed, and prevent illegal acts such as the occupation, blocking, and sealing of evacuation routes, safety exits, and fire truck access. If preventionis ineffective, reports should be submitted to fire rescue organizations and other relevant administrative departments ;

(6)to supervise owners and users to fulfill their fire safety obligations;

(7)to regularly report the fire safety situation to the homeowners' committee and owners and users of the residential community, and alert them to fire safety risks;

(8)to organize regular fire safety publicity and education;

(9)to formulate fire-fighting and emergency evacuation plans, and regularly organize drills;

(10)to perform other fire safety responsibilities stipulated by laws, regulations, rules, and contracts.


第十八条供水、供电、供气、供热、通信、有线电视等专业运营单位,依法对高层建筑内由其管理的设施设备的消防安全负责,并定期进行检查和维护,指导用户消除安全隐患。

供水企业应当为高层建筑消防设施和消防演练提供稳定水源,配合相关专业机构开展消防设施维修、保养和检测。

供电、供气企业应当指导高层建筑的物业服务企业或者统一管理人做好发生火灾时公共区域的电力、燃气处置工作。

Article 18Professional operating units such as water supply, electricity supply, gas supply, heating supply, communications, cable television, etc., are responsible for the fire safety of the facilities and equipment they manage within high-rise buildings according to law, and they should regularly conduct inspections and maintenance, and guide users to eliminate safety hazards.

Water supply companies shall provide stable water sources for the fire-fighting facilities and fire drills of high-rise buildings and cooperate with relevant professional institutions to carry out maintenance, upkeep, and inspection of fire-fighting facilities.

Electricity and gas supply companies shall guide property service companies or unified managers of high-rise buildings to properly handle electricity and gas in public areas in the event of a fire.


第十九条本市鼓励在高层住宅建筑中明确消防安全楼门长,负责日常防火巡查和消防宣传提示,对发现的占用、堵塞、封闭疏散通道、安全出口和消防车通道,未关闭常闭式防火门,占用电缆井、管道井等竖向管井,电动车违规停放充电等问题及时报告业主委员会、物业服务企业或者村民委员会、居民委员会。

Article 19 This Municipality encourages a volunteer in high-rise residential buildings to be responsible for daily fire prevention patrol and fire protection publicity. He or she should promptly report to the owners’ committees, realty service enterprises, villagers’ committees and residents’ committees any problems found, such as occupying, blocking or closingan evacuation passage, safety exit and fire truck passage, failure to close normally closed fire doors, occupation of vertical pipeline wells such as cable wells and pipeline wells, illegal parking and charging of electric vehicles, etc.


第三章消防宣传教育和灭火疏散预案

Chapter III Fire Protection Publicity and Education and Firefighting and Evacuation Preparedness Plan


第二十条消防救援机构、公安派出所、村民委员会、居民委员会应当组织、指导物业服务企业或者统一管理人利用楼宇电视、社区电子显示屏、固定宣传栏等宣传载体开展高层建筑消防宣传教育,普及高层建筑消防安全知识。

物业服务企业应当向业主委员会报告高层建筑消防设施运行状态,并向全体业主、使用人公示高层建筑设施完好情况;可以在保障安全的情况下,向业主、使用人开放消防设施设备间、消防控制室。

高层建筑的业主、使用人应当学习和掌握高层建筑火灾应对知识和灭火求生技能。

Article 20 The fire and rescue departments, police stations, villagers’ committeesorresidents’ committees shall organize and guide realty service enterprises or unified managers to carry out fire protection publicity and education in high-rise buildings by using available media such as building television, community electronic display screens and fixed billboards, so as to popularize fire safety knowledge in high-rise buildings.

The realty service enterprises shall report to the owners’ committee the operating status of the fire protectionfacilities of the high-rise building, and publicize the integrity of the high-rise building facilities to all owners and users; under the condition of ensuring safety, fire protectionfacilities and equipment rooms and fire protection rooms can be open to owners and users.

Owners and users of high-rise buildings should learn and graspthe knowledge of high-rise building fire response and fire fighting survival skills.


第二十一条高层建筑应当在每层的显著位置张贴安全疏散示意图,公共区域电子显示屏应当播放消防安全提示和消防安全知识。

高层公共建筑除遵守本条第一款规定外,还应当在首层显著位置提示公众注意火灾危险,以及安全出口、疏散通道和灭火器材的位置。

高层住宅小区除遵守本条第一款规定外,还应当在显著位置设置消防安全宣传栏,在高层住宅建筑单元入口处提示安全用火、用电、用气,以及电动自行车存放、充电等消防安全常识。

Article 21A diagrammatic sketch for evacuation routes shall be posted in a conspicuous positionon each floor, and electronic display screensin public areas should broadcast fire safety tips and fire safety knowledge.

In addition to the provisions of the first paragraph of this article, the high-rise public buildingsshall remind the fire danger in a conspicuous position on the first floor of the public building, as well as the locations of safety exits, evacuation passages and fire extinguishers.

In addition to the provisions of the first paragraph of this article, high-rise residential quartersshall also set up fire safety billboards in conspicuous positions, and prompt fire safety knowledge such as the safe use of fire, electricity and/or gas, and storage and charging of electric bicycles at the entrance of high-rise residential building entities.


第二十二条高层公共建筑内的单位应当每半年至少对员工开展一次消防安全教育培训。

高层公共建筑内的单位应当对本单位员工进行上岗前消防安全培训,并对消防安全管理人员、消防控制室值班人员和操作人员、电工、保安员等重点岗位人员组织专门培训。

高层住宅建筑的物业服务企业应当每年至少对居住人员进行一次消防安全教育培训,进行一次疏散演练。

Article 22Entities in high-rise public buildings should carry outfire safetyeducation and trainingfor employees at least once every six months.

Entities in high-rise buildings shall providepre-servicefire safety training for their employees, and organize specialized training for key positions such as fire safety managers,fire safety managers, duty staff and operators in the fire control room, electricians, security guards, and so forth.

The realty service enterprise of high-rise building shall carry outfire safetyeducation and training for residents at least once a year, and conduct an evacuation drilling.


第二十三条高层建筑应当结合场所特点,分级分类编制灭火和应急疏散预案。

规模较大或者功能业态复杂,且有两个及以上业主、使用人或者多个职能部门的高层公共建筑,有关单位应当编制灭火和应急疏散总预案,各单位或者职能部门应当根据场所、功能分区、岗位实际编制专项灭火和应急疏散预案或者现场处置方案(以下统称分预案)。

灭火和应急疏散预案应当明确应急组织机构,确定承担通信联络、灭火、疏散和救护任务的人员及其职责,明确报警、联络、灭火、疏散等处置程序和措施。

Article 23 A classified firefighting and emergency evacuation preparedness plan should be designed for high-rise buildings in combination with the characteristics of the site.

For large-scale high-rise public buildings or those with complex functional formats, and where there are two or more owners or users, or multiple functional departments, the relevant entities shall prepare general fire extinguishing and emergency evacuation plans. Each entity or functional department should prepare specialized fire extinguishing and emergency evacuation plans or on-site handling schemes (hereinafter referred to as sub-plans) based on the actual conditions of the premises, functional zones, and positions.

Fire extinguishing and emergency evacuation plans shall specify the emergency organization, identify the personnel and their responsibilities for communication, fire extinguishing, evacuation, and rescue tasks, and clearly define the procedures and measures for alarms, contacts, fire extinguishing, and evacuation.


第二十四条高层建筑的业主、使用人、受委托的消防服务单位应当结合实际,按照灭火和应急疏散总预案和分预案分别组织实施消防演练。

高层建筑应当每年至少进行一次全要素综合演练,建筑高度超过100米的高层公共建筑应当每半年至少进行一次全要素综合演练。编制分预案的,有关单位和职能部门应当每季度至少进行一次综合演练或者专项灭火、疏散演练。

演练前,有关单位应当告知演练范围内的人员并进行公告;演练时,应当设置明显标识;演练结束后,应当进行总结评估,并及时对预案进行修订和完善。

Article 24The owners, users,and entrusted fire service entities of high-rise buildings should respectively organize thefire protection drilling in combination with the actual situation, in accordance with the firefighting and emergency general evacuation preparedness plan and sub-plans.

High-rise buildings should conduct at least one comprehensive drill involving all elements each year, and high-rise public buildings over 100 meters in height should conduct at least one such drill every six months. In the preparation of sub-plans, the relevant entities and functional departments shall conduct at least one comprehensive or specialized fire extinguishing and evacuation drill each quarter.

Before the drill, relevant entities should notify personnel within the drill range and make an announcement; during the drill, conspicuous signs should be set up; after the drill, a summary evaluation should be carried out, and the plans should be revised and improved in a timely manner.


第二十五条高层建筑的物业服务企业或者统一管理人应当配合消防救援机构或者专职消防队开展以初起火灾扑救、人员自救互救、各方协同作战为主要内容的消防联合演练。

高层建筑的志愿消防队(微型消防站)应当接受属地消防救援机构的指导,服从火灾扑救现场统一指挥调度。

Article 25 The realty service enterprises or unified managers of high-rise buildings shall cooperate with the fire and rescue department or full-time fire brigade to carry out joint fire drills with the initial fire fighting, self-help and mutual rescue of personnel and coordinated operations of all parties as the main contents.

The volunteer fire brigades (micro-sized fire stations) of the high-rise building shall accept the guidance of the local fire and rescue department and obey the unified command and dispatch of the fire fighting scene.


第二十六条高层公共建筑内的人员密集场所应当按照楼层、区域确定疏散引导员,负责在火灾发生时组织、引导在场人员安全疏散。

Article 26Apeople-intensive site of thehigh-rise public buildingsshall be floor by floor, or area by area, to organize and guide the safe evacuation in case of fire.


第二十七条火灾发生时,发现火灾的人员应当立即拨打119电话报警。

火灾发生后,高层建筑的业主、使用人、消防服务单位应当迅速启动灭火和应急疏散预案,组织人员疏散,扑救初起火灾。

火灾扑灭后,高层建筑的业主、使用人、消防服务单位应当组织保护火灾现场,协助火灾调查。

Article 27 When a fire breaks out, the person who finds the fire shall immediately call 119 to reportto the police.

After a fire, the owners, users or fire service entities of high-rise buildings should quickly start the firefighting and emergency evacuation preparedness plan, organize personnel evacuation and put out the initial fire.

After the fire is extinguished, the owners, users or fire service entities of high-rise buildings shall organize and protect the fire scene and assist in the fire investigation.



第四章消防安全管理

Chapter IV Fire Safety Management


第二十八条高层公共建筑内有关单位、高层住宅建筑所在社区居民委员会、村民委员会或者物业服务企业按照规定建立专职消防队、志愿消防队(微型消防站)等消防组织,配备必要的人员、场所和器材、装备,定期进行消防技能培训和演练,开展防火巡查、消防宣传,及时处置、扑救初起火灾。

设计总户数超过2000户的高层住宅建筑小区、建筑高度超过100米或者建筑面积5万平方米以上的高层公共建筑,有关单位应当根据建筑特点和快速灭火救援的原则,在重点部位、重点区域分散设置多个消防器材存放点。

Article 28Relevant entities in high-rise public buildings, community residents’ committees, villagers’ committees or realty service enterprises where high-rise residential buildings are located shall formfull-time fire brigades, volunteer fire brigades (micro-sized fire stations) and other fire protection organizations in accordance with provisions, equip them with the necessary personnel, places, apparatuses and equipment, conduct regular fire protection skills training and drilling, conduct fire prevention patrols and fire protection publicity, and timely deal with and put out initial fires.

For high-rise residential quarters with a total design number of more than 2,000 households and high-rise public buildingsover 100 meters or a building area of more than 50,000 square meters, the relevant entities shall, according to the building characteristics and the principle of quick fire fighting and rescue, set up multiple fire apparatuses storage points in key spots and key areas.


第二十九条在高层建筑设置下列消防安全标志应当符合国家标准、行业标准,并加强日常维护管理,保持完好有效:

(一)高层公共建筑内禁火禁烟区域的明显标志;

(二)锅炉房、变配电室、空调机房、自备发电机房、储油间、消防水泵房、消防水箱间、防排烟风机房等消防安全重点部位设置明显的防火标志;

(三)疏散通道、安全出口、消防车通道、消防车登高操作场地、灭火救援窗、灭火救援破拆口、室外消火栓、消防水泵接合器、消防车取水口、常闭式防火门等场所和设施设置醒目的提示性和警示性标识;

(四)在显著位置设置的指示避难层(间)位置的标识;

(五)消防车通道、消防车登高操作场地、防火卷帘下方,地面禁止占用区域范围的标识;

(六)消火栓箱、灭火器箱上张贴的使用方法标识;

(七)楼梯间每层设置的指示该楼层的标志灯;

(八)按照国家标准、行业标准设置的其他消防安全标志。

Article 29 The following fire safety signs installed in high-rise buildings shall conform to the national standards and industrial standards,and strengthen the daily management of maintenance thereof, to keep the samein good condition and effective:

(1)Obviouswarning signs of fire and smoke prohibition areas in high-rise public buildings;

(2)Obvious fire prevention signs in the key fire safety spots such as boiler rooms, power transformation and distribution rooms, air conditioning rooms, self-provided generator rooms, oil storage rooms, fire pump rooms, fire water tank rooms, smoke control fan rooms, etc. ;

(3)Obvious promoting and warning signs in the places and facilities such as evacuation passages, safety exits, fire truck passages, fire truck climbing operation sites, fire rescue windows, fire rescue breaks, outdoor fire hydrants, fire pump adapters, fire truck water intakes, normally closed fire doors, etc. ;

(4)Signs indicating the location of refuge layers (rooms) set at conspicuous positions;

(5)Signs of fire truck access, fire truck climbing operation site, under the fire shutter, and the area where the ground is not allowed to be occupied;

(6)Use method identification posted on the fire hydrant box and fire extinguisher box;

(7)Signs and lights on each floor of the staircase to indicate the floor; or

(8)Other fire safety signs in accordance with national standards and industrial standards.



第三十条高层建筑的物业服务企业或者统一管理人应当加强对消防车通道的管理,按照标准施划消防车通道标志标线,预留消防车通行宽度,满足消防车通行及转弯的要求,保障消防车通道通畅。

无物业服务企业或者统一管理人的,高层建筑所在地乡镇人民政府、街道办事处应当按照标准组织开展消防车通道标志标线施划工作。

Article 30 The realty service enterprises or unified managers of high-rise buildings shall strengthen the management of fire truck passages, draw fire truck passage signs and markings according to the standards, reserve the width of fire truck passage which meets the requirements of fire truck passage and turning, and ensure the fire truck passages are clear.

If there are no realty service enterprises or unified managers, the township(town) peoples governmentsorurban sub-district offices where the high-rise building is located shall organize the marking work of fire truck passage according to the standard.


第三十一条高层建筑的户外广告牌、外装饰不得采用易燃、可燃材料,不得妨碍防烟排烟、逃生和灭火救援,不得改变或者破坏建筑立面防火结构。建筑高度超过50米的高层建筑外墙上设置的装饰、广告牌应当采用不燃材料并易于破拆。

Article 31 The outdoor advertisement boardsor external decorations of high-rise buildings shall not be made of flammable,combustible materials, which shall not obstruct smoking exhaust,peoples fleeing to safety, or fire fighting or rescue, and shall not change or destroy the fire protection structure of the building facade. Decorations andadvertisement boardsset on the outside walls of high-rise buildings with a height of more than 50 meters shall be made of inflammable and removable materials.


第三十二条设有建筑外墙外保温系统的高层建筑,其管理单位应当在主入口及周边相关显著位置,设置提示性和警示性标识,标示外墙外保温材料的燃烧性能、防火要求。对高层建筑外墙外保温系统破损、开裂和脱落的,应当及时修复。高层建筑在进行外墙外保温系统施工时,建设单位应当采取必要的防火隔离以及限制住人和使用的措施,确保建筑内人员安全。

Article 32 The management entity of a high-rise building with an external thermal insulation system of the building’s outside wall shall set up suggestive and warning signs at the main entrance and surrounding conspicuous positions to indicate the combustion performance and fire prevention requirements of external thermal insulation materials of the building outside wall. If the external insulation system of the external wall of a high-rise building is damaged, cracked and falls off, it should be timely repaired. When an external thermal insulation system of the outside wall is being constructed, the construction entities shall take necessary measures to prevent fire and restrict the occupancy and use of the building by people, so as to ensure the safety of people in the building.


第三十三条高层建筑的电缆井、管道井等竖向管井和电缆桥架应当在每层楼板处进行防火封堵,井壁耐火极限、管井检查门以及电缆井内电器线路的敷设应当符合消防技术标准和管理规定。

Article 33 The vertical pipeline wells and cable trays of high-rise buildings, such as cable wells and pipeline wells, shall fire sealingfrom fire on each floor. The fire resistance limit of the shaft wall, the inspection doors of the pipeline wells and the laying of electrical circuits in the cable wells shall conform to the provisions on fire protection technical standards and administration.



第三十四条高层建筑内燃气用具的安装使用及其管路敷设、维护保养和检测应当符合消防技术标准及管理规定,遵守国家和本市燃气安全使用管理的有关规定。

Article 34 The installation, useof gas utensilsand thethe laying, maintenance and testing of pipes of gas utensils in high-rise buildings shall conform to the provisions on fire protection technical standards and administration, and comply with the relevant provisions of the state and this Municipality on the safe use and management of gas.


第三十五条高层建筑的业主、使用人或者物业服务企业、统一管理人应当对动用明火作业实行严格的消防安全管理,不得在具有火灾、爆炸危险的场所使用明火;因施工等特殊情况需要进行电焊、气焊等明火作业的,应当按照规定办理动火审批手续,落实现场监护人,配备消防器材,并在建筑主入口和作业现场显著位置公告。作业人员应当依法持证上岗,严格遵守消防安全规定,清除周围及下方的易燃、可燃物,采取防火隔离措施。作业完毕后,应当进行全面检查,消除遗留火种。

高层公共建筑内的商场、公共娱乐场所不得在营业期间动火施工。

Article 35 The owners and users of high-rise buildings, or realty service enterprises and unified managers shall implement strict fire safety management for any operation with open flames, and shall be forbidden to use naked fire at a place with a risk of fire disaster or explosion;if it is necessary to use naked fire in the construction such as electric welding and gas welding or in any other special cases,the relevant party shall go through the formalities for a prior approval in accordance with the provisions, implement the on-site guardian, equip with fire apparatus, and make an announcement in a conspicuous position at the main entrance of the building and the operation site. Operation staff shall assume their posts with corresponding qualification certificates according to law and strictly abide by the fire safety provisions, remove flammable and flammable materials around and below, and take fire isolation measures. They shall conduct comprehensive inspections after the operation and eliminate the remained fire.

Any operation involving the use of fire is not allowed at shopping malls and public entertainment venues in high-rise buildings during the course of business operations.


第三十六条生产、储存、经营易燃易爆危险品的场所不得与居住场所设置在同一高层建筑内,并应当与居住场所保持安全距离。

Article 36 In arrangement, a site for the production, storage or trade of dangerous articles such as flammables, and explosives shall not be in the same building as a residential site is, and shall keep a safe distance from a residential site.


第三十七条高层公共建筑的业主、使用人应当按照国家标准、行业标准配备灭火器材以及自救呼吸器、逃生缓降器、逃生绳等逃生疏散设施器材。

高层住宅建筑应当在公共区域的显著位置摆放灭火器材,有条件的配置自救呼吸器、逃生绳、救援哨、疏散用手电筒等逃生疏散设施器材。

鼓励高层住宅建筑的居民家庭制定火灾疏散逃生计划,并根据不同楼层实际情况配备符合国家标准、行业标准的燃气报警器、独立式火灾探测报警器和逃生缓降器、逃生绳、灭火器、灭火毯、自救呼吸器、口哨、手电筒等灭火自救逃生器材,增强自防自救能力。

Article 37 The owners and users of high-rise public buildings shall, in accordance with national standards and industrial standards, be equipped with fire extinguishers, self-rescue respiratory devices, descending lifelines, escape ropes and other escape and evacuation facilities and equipment.

High-rise residential buildings should be placedfire extinguishers in conspicuous positions in public areas, and equipped with self-rescue respiratory devices, escape ropes, rescue posts, evacuation torches and other evacuation facilities.

Residents in high-rise residential buildings are encouraged to work out fire evacuation and escape plans, and to be equipped with gas alarms, independent fire detection alarms and descending lifelines, escaping ropes, fire extinguishers, fire blankets, self-rescue respiratory devices, whistles, torches and other fire-fighting and self-help escaping equipment that meet national standards and industry standards according to the actual situation of different floors, so as to enhance self-protection and self-rescueability.


第三十八条新建高层建筑应当按照国家和本市有关规范和标准,配套规划建设电动车集中停放、充电场所,配置具备定时充电、自动断电、故障报警等功能的安全充电设施。

高层住宅建筑和执行居民电价的高层公共建筑设置的电动车集中充电设施用电,执行居民生活用电价格。国家另有规定的,按照国家相关规定执行。

Article 38 Centralized parking and charging places for electric vehicles should be planned and constructed for newly-built high-rise buildings in accordance with the relevant norms and standards of the state and this Municipality. These places shall be configured with safe charging facilities with functions such as regular charging, automatic power failure and fault alarm.

High-rise residential buildings and high-rise public buildings for which residential electricity price is applicable shall execute the price of power consumed by residents daily lives.If any national provisions, the provisions shall prevail.


第三十九条为电动车充电应当符合用电安全要求。禁止在高层建筑共用走道、楼梯间、安全出口等公共区域停放电动车。禁止携带电动车或者电动车电池进入电梯轿厢。

居民委员会、村民委员会、物业服务企业或者其他管理人应当做好电动车停放、充电的巡查、检查工作,发现电动车违法违规停放、充电的,有权予以劝阻;劝阻无效的,向消防救援机构或者乡镇人民政府、街道办事处报告。

本市鼓励电梯加装电动车智能阻止系统。

Article39 Charging an electric vehicle shall meet the requirements of electricity safety. It is forbidden to park electric vehicles in public areas such as shared walkways, stairwells and safety exits in high-rise buildings. It is forbidden to bring electric vehicles or electric vehicle batteries into elevator cabins.

Residents’ committees, villagers’ committees, realty service enterprises or other managers shall do a good job in the patrol and inspection of parking and charging of electric vehicles, and have the right to dissuade illegal parking and charging of electric vehicles; if the dissuasion does not work, they should report the situation to the fire and rescue departments or the township(town) peoples governments or urban sub-district administrative offices.

Encourage elevators in this city to install intelligent stopping systems for electric vehicles.


第四十条高层公共建筑内餐饮场所的经营单位应当及时对厨房灶具和排油烟罩设施进行清洗,排油烟管道等设施每季度至少进行一次检查、清洗并做好记录,保留检查、清洗记录的时间不少于2年。

高层住宅建筑的物业服务企业或者统一管理人应当对公共排烟管道定期检查,并采取防火措施。

Article 40 The business entities of catering establishments in high-rise public buildings shall timely clean the kitchen stoves and fume exhaust hood facilities, and the oil fume discharging pipes and other facilities shall be inspected and cleaned at least once every quarter and recorded, and the inspection and cleaning records shall be kept for at least two years.

The realty service enterprises or unified managers of high-rise residential buildings shall regularly inspect the public smoke exhaust pipes and take fire prevention measures.


第四十一条高层公共建筑内的托儿所、幼儿园的儿童用房、儿童游乐厅等儿童活动场所和老年人照料设施及其安全出口、疏散楼梯和避难间的设置,应当符合国家建筑设计防火规范。

Article 41 The setting of nurseries, kindergartens, children’s rooms, children’s playhouses and other places for children’s activities and elderly care facilities in high-rise public buildings, as well as their safety exits, evacuation staircases and firerefuge rooms, shall comply with the national fire protection code for architectural design.


第四十二条高层公共建筑内的剧本娱乐经营场所应当落实消防安全规定,开展火灾风险自查整改,提高疏散逃生和火灾扑救能力,履行安全提示和告知义务,保障安全运营。

文化和旅游部门应当指导、督促剧本娱乐经营场所履行消防安全责任,配合消防救援机构和相关部门依法依规开展剧本娱乐经营场所消防监督检查工作。

文化和旅游部门应当会同公安机关、住房城乡建设部门、市场监督管理部门、消防救援机构等建立协同监管机制,建立信息通报、线索移送和联合执法等工作机制,加强剧本娱乐经营场所管理。

Article 42 The business premises of recreational scripts in high-rise public buildings shall implementfire safety provisions, carry out self-examination and rectification of fire risks, improve the ability of evacuation and firefighting, fulfill the obligation of safety prompt and notification, and ensure safe operation.

The culture and tourism departments should direct and urgethe business premises of recreational scripts to fulfill their fire safety obligations, and cooperate with the fire and rescue departments and relevant departments to carry out the fire supervision and inspection work of business premises of recreational scripts according to laws and regulations.

The culture and tourism departments shall, in conjunction with the public security authorities, housing and urban-rural development authorities, market supervision and management departments, fire rescue agencies, etc., establish a collaborative supervision mechanism, establish working mechanisms such as information notification, clue transfer and joint law enforcement, and strengthen the management of the business premises of recreational scripts.


第四十三条在高层建筑内举办大型群众性活动,承办人应当依法向公安机关申请安全许可,制定灭火和应急疏散预案并组织演练,明确消防安全责任分工,确定消防安全管理人员,保持消防设施和消防器材配置齐全、完好有效,保证疏散通道、安全出口、疏散指示标志、应急照明和消防车通道符合消防技术标准和管理规定。

Article 43To hold a large-scale mass activity in a high-rise building, the organizer shall apply to the public security organ for a safety permit, work out a firefighting and emergency evacuation preparedness plan, organize drillings, make a clear division of fire safety responsibilities, determine fire safety managers, keep the fire protection facilities and apparatuses complete, in good condition and effective, and ensure that the evacuation passages, safety exits, evacuation direction signs, emergency illuminations and fire truck passages conform to the provisions on fire protection technical standards and administration.


第四十四条对建筑高度超过100米的高层建筑,有关单位应当应用物联网和智能化技术对电气、燃气消防安全和消防设施运行等进行监控和预警。

Article 44 For high-rise buildings with a building height of more than 100 meters, the relevant entities shall apply the Internet of Things and intelligent technology to monitor and warn the electrical and gas fire safety and the operation of fire protection facilities.


第四十五条任何单位、个人不得从事下列危害高层建筑消防安全的行为:

(一)在外墙周围堆放可燃物;

(二)违反规定在外墙动火用电;

(三)占用电缆井、管道井等竖向管井,或者在竖向管井内堆放杂物;

(四)在外窗设置影响逃生和灭火救援的障碍物;

(五)在消防车通道、消防车登高操作场地设置构筑物、停车泊位、固定隔离桩等障碍物;

(六)在消防车通道上方、登高操作面设置妨碍消防车作业的架空管线、广告牌、装饰物等障碍物;

(七)占用锅炉房、变配电室、空调机房、自备发电机房、储油间、消防水泵房、消防水箱间、防排烟风机房等设备用房,或者在设备用房内堆放杂物;

(八)堆放物品、锁闭出口、设置障碍物等妨碍疏散通道、安全出口通畅的行为;

(九)圈占、遮挡消火栓;

(十)在消火栓箱内堆放杂物;

(十一)在防火卷帘下堆放物品;

(十二)占用避难层(间)和避难走道或者堆放杂物;

(十三)锁闭避难层(间)和避难走道出入口;

(十四)法律、法规、规章规定的其他危害高层建筑消防安全的行为。

Article 45 No entity or individual shall engage in the following acts that endanger the fire safety of high-rise buildings:

(1)Stack flammable materials around the outside wall;

(2)Use fire and electricity on the outside wall in violation of provisions;

(3)Occupyvertical pipeline wells such as cable wells and pipeline wells, or stacking sundries in vertical pipeline wells;

(4)Set any barrier on the outer window, which may affect the people’s fleeing to safety and fire fighting and rescue;

(5)Set up structures, parking spaces, fixed isolation piles and other barriers in the fire truck passage and fire truck climbing operation site;

(6)Set up overhead pipelines, advertisement boards, decorations and otherbarriersimpeding the operation of the fire truck above the fire truck passage or the climbing operation surface;

(7)Occupy boiler room, power transformation and distribution room, air conditioning room, self-contained generator room, oil storage room, fire pump room, fire water tank room, smoke control fan room and other equipment rooms, or stack sundries in the equipment room;

(8)Stack article, lock exit, set any barrier and other act that obstruct the smooth passage of evacuation and safety exit;

(9)Occupy or cover a fire hydrant;

(10)Stack sundries in the fire hydrant boxes;

(11)Stack articles under the fire shutter;

(12)Occupyrefuge layers (rooms) and refuge walkways or stack items therein;

(13)Lock the entrance and exit of the refuge layers (rooms) and refuge walkway; or

(14)Other behaviors that endanger the fire safety of high-rise buildings as stipulated by laws, regulations and rules.


第四十六条本市鼓励单位和个人及时举报危害高层建筑消防安全的违法行为。

消防救援机构、乡镇人民政府、街道办事处、公安机关以及住房城乡建设等部门应当按照各自职权对危害高层建筑消防安全的违法行为进行核查并依法处理,并将处理情况反馈举报人。

Article 46 This Municipality encourages entities and individuals to promptlyreport illegal acts endangering the fire safety of high-rise buildings.

The fire and rescue departments, township(town) peoples governments, urban sub-district administrative offices, public security authorities, housing and urban-rural development authorities and other departments shall, according to their respective functions and powers, inspect and handle the illegal acts endangering the fire safety of high-rise buildings in accordance with the law, and feedback the handling situation to informants.


第四十七条高层建筑共用消防设施日常运行和维护费用,除物业服务合同另有约定外,由物业服务费用支出。

高层建筑共用消防设施在国家规定的保修期内,依法由建设单位承担保修责任。保修期满后,高层建筑共用消防设施的维修、更新、改造费用可以按照国家和本市规定申请使用专项维修资金;未建立专项维修资金或者专项维修资金余额不足的,高层建筑共用消防设施的维修、更新、改造费用由业主、使用人按照约定承担,没有约定或者约定不明的,由业主按照各自专有部分面积所占比例承担。

高层建筑共用消防设施严重损坏危及业主住用安全的,业主委员会或其委托的物业服务企业应当立即组织维修;未及时组织维修的,由属地乡镇人民政府、街道办事处会同有关主管部门组织维修,维修费用可以按照国家和本市规定申请使用专项维修资金。

高层建筑共用消防设施维修、更新、改造情况以及相关维修资金的申请、使用情况等以合理方式向业主、使用人公开。

Article 47 The routine operations and maintenance expenses of common fire protectionfacilities in a high-rise building shall be paid by the realty service expenses unless otherwise agreed in the realty service contract.

In the warranty periodprovided by national regulations, the common fire protectionfacilities in a high-rise building shall be guaranteed by the construction entity according to law. After the expiration of the warranty period, the maintenance, renewal andreconstruction costs of shared fire protection facilities in high-rise buildings can be paid by special fund in accordance with the provisions of the state and this Municipality; if no special fund is established or the balance of special fund is insufficient, the cost of maintenance, renewal andreconstruction of shared fire-fighting facilities in high-rise buildings shall be borne by the owners and users in accordance with the agreement. In the absence of such an agreement or of any clear agreement thereupon, the owners shall bear it in accordance with the proportion of their respective proprietary areas.

If the common fire protectionfacilities in a high-rise building are seriously damaged and bring risks to the safety of the owners, the owners’ committees or their entrusted realty service enterprises shall immediately carry out maintenance; if the maintenance fails to timely organized, the local township(town) peoples government, the urban sub-district administrative office and relevant competent departments shall carry out maintenance, and the maintenance expenses may be paid by special fund in accordance with the provisions of the state and this Municipality.

The maintenance, renewal andreconstruction of common fire protectionfacilities in a high-rise building and the application and use of related maintenance funds should be disclosed to the owners and users in a reasonable way.


第四十八条市和区人民政府应当将消防安全隐患突出的老旧高层住宅小区及远年商品住房纳入改造计划,修缮老旧消防设施,增配火灾应急广播、独立式火灾探测报警器、灭火器材等相应的消防设施,提高火灾预警和处置能力,改善消防安全条件。

改造后消防设施的维护管理由物业服务企业负责;未实行物业管理的,由乡镇人民政府、街道办事处负责。

乡镇人民政府、街道办事处应当在老旧高层住宅小区周边,采取协调扩充车位、引导分流分时停车等措施,保障小区消防车通道不被占用。

Article 48 The municipal and district people’s government shall incorporate the old high-rise residential quarters and commodity houses with outstanding fire safety hazards into the reconstruction plan, repair the old fire protectionfacilities, and add corresponding fire protectionfacilities such as fire emergency radio, independent fire detection alarms, fire extinguishers, etc., so as to improve the abilities of fire early-warning and disposal, and improve fire safety conditions.

After the reconstruction, the maintenance and management of fire protection facilities shall be undertaken by the realty service enterprise; and if realty management is not implemented, the township(town) peoples governments and the urban sub-district administrative offices shall be responsible for it.

Township(town) peoples governmentorurban sub-district administrative office should take measures such as coordinating and expanding parking spaces, guiding diversion and time-sharing parking, etc. around old high-rise residential quarters, so as to ensure that the fire truck passage in residential quarters is not occupied.


第五章法律责任

Chapter V Legal Liability


第四十九条各级人民政府及有关部门和消防救援机构未履行本规定职责的,由本级人民政府或者上级人民政府有关部门责令改正;情节严重的,对直接负责的主管人员和其他直接责任人员,由有权机关依法给予处分。

Article 49 If the people’s governments at all levels, relevant departments and the fire and rescue departments fail to perform their duties as prescribed in these provisions, the people’s government at the same level or the relevant department of the people’s government at a higher level shall order the taking of corrective action; if the circumstances are serious, the directly liable person in charge and other directly liable persons shall be given a sanction by the competent authority according to law.


第五十条消防救援机构在消防监督检查中发现火灾隐患的,应当通知有关单位或者个人立即采取措施消除隐患;不及时消除隐患可能严重威胁公共安全的,消防救援机构应当依照规定对危险部位或者场所采取临时查封措施。

Article 50 Where the fire and rescue department finds any potential fire risk during the fire protection supervision and inspection, it shall notify the relevant entity or individual to immediately take measures for eliminating the potential risk. If the public safety may be seriously endangered as a result of a failure to timely eliminate the potential risk, the fire and rescue department shall temporarily seal up the dangerous spot or site according to the relevant provisions.


第五十一条单位设置消防安全标志不符合国家标准、行业标准,或者未保持完好有效的,由消防救援机构责令改正,处五千元以上五万元以下罚款。

Article 51 Where any entity fails to set upfire safety signs conforming to the national standards or industrial standards, or fails to keep the same in good condition and effective, the fire and rescue department shall order the taking of corrective action and impose a fine of not less than 5,000 yuan but not more than 50,000 yuan.


第五十二条设置的户外广告牌、外装饰妨碍防烟排烟、逃生和灭火救援,或者改变、破坏建筑立面防火结构的,由消防救援机构责令改正,处五百元以上一万元以下罚款。

Article 52 Wherean outdoor advertisement boardor external decoration obstructs smoke exhaust, people’sfleeing to safety and fire fighting or rescue, or change or destroy the fire protection structure of the building facade, the fire and rescue department shall order it to take corrective action and impose a fine of not less than 500 yuan and but not more than 10,000 yuan.


第五十三条未设置外墙外保温材料提示性和警示性标识,或者未及时修复破损、开裂和脱落的外墙外保温系统的,由消防救援机构责令改正,处五百元以上一万元以下罚款。

Article 53 Wherenot set the prompt and warning signs of outside wall thermal insulation materials, or fail to timely to repair the broken or destroyed, cracked and detached outside wall thermal insulation system, the fire and rescue department shall order it to take corrective action and impose a fine of not less than 500 yuan and but not more than 10,000 yuan.


第五十四条在高层建筑内进行电焊、气焊等明火作业,未履行动火审批手续、进行公告,或者未落实消防现场监护措施的,由消防救援机构责令改正,处五百元以上一万元以下罚款。

Article 54 Where anycarries out electric welding, gas welding and other open flame operations in a high-rise building, fails to go through the formalities for approval of hot work and make an announcement, or fails to implement the monitoring measures on the fire scene, the fire and rescue department shall order it to take corrective action and impose a fine of not less than 500 yuan but not more than 10,000 yuan.


第五十五条生产、储存、经营易燃易爆危险品的场所与居住场所设置在同一高层建筑内,或者未与居住场所保持安全距离的,由消防救援机构责令停产停业,并处五千元以上五万元以下罚款。

Article 55 Where a site for the production, storage or trade of such dangerous articles as flammablesor explosives is arranged in the same high-rise building as a residential site is or does not keep a safe distance from the residential site, the fire and rescue department shall order it to stop production and business operation and be fined not less than 5,000 yuan but not more than 50,000 yuan.


第五十六条携带电动车或者电动车电池进入电梯轿厢的,由消防救援机构或者乡镇人民政府、街道办事处责令改正;拒不改正的,处警告或者一千元以下罚款。

Article 56 Where anyone who carries an electric vehicle or electric vehicle batteries into the elevator cabins, the fire and rescue department or the township(town) peoples government or the urban sub-district administrative officeshall order it to take corrective action; if it refuses to take corrective action, shall be given a warning or be fined not more than 1,000 yuan on it.


第五十七条设置障碍物妨碍消防车登高操作的,由消防救援机构责令改正;逾期不改正的,对单位处一千元以上一万以下罚款,对个人处警告或者一千元以下罚款。

Article 57 Where setting any barrierobstructs fire engines from climbing, the fire and rescue department shall order it to take corrective action; and if failing to make the correction within the prescribed time limit, it shall be fined not less than 1,000 yuan or but not more than 10,000 yuan on the entity, and be given a warning or be finednot more than 1,000 yuan on the individual.


第五十八条有下列行为之一的,由消防救援机构责令改正,对单位处五千元以上五万元以下罚款,对个人处警告或者五百元以下罚款:

(一)损坏、挪用或者擅自拆除、停用消防设施、器材的;

(二)占用、堵塞、封闭疏散通道、安全出口或者有其他妨碍安全疏散行为的;

(三)埋压、圈占、遮挡消火栓或者占用防火间距的;

(四)占用、堵塞、封闭消防车通道,妨碍消防车通行的。

Article 58 Where any of the following conduct is committed,the fire and rescue department shall order it to take corrective action, impose a fine of not less than 5,000 yuan but not more than 50,000 yuan on the entity, andbegiven a warning or be fined not more than 500 yuan on the individual:

(1)Having damaged, misappropriated or illegally dismantled or stopped the use of any fire protection facility or apparatus;

(2)Having occupied, blocked or closed any evacuation passage or safety exit, or having committed any other act that may obstruct safe evacuation;

(3)Having buried, occupied or covered any fire hydrant or having occupied fire separation distance; or

(4)Having occupied, blocked or closed any fire truck passage or obstructing the passage of a fire truck.


第五十九条单位在人员密集场所门窗上设置影响逃生和灭火救援的障碍物的,由消防救援机构责令改正,处五千元以上五万元以下罚款。

Article 59 Where anentity setsany barrier on the window of a people-intensive site, which may affect the peoples fleeing to safety and fire fighting and rescue, the fire and rescue department shall order it to take corrective action and be fined not less than 5,000 yuan nor more than 50,000 yuan on it.


第六章附则

Chapter VI Supplementary Provisions


第六十条本规定下列用语的含义:

(一)高层住宅建筑,是指建筑高度大于27米的住宅建筑。

(二)高层公共建筑,是指建筑高度大于24米的非单层公共建筑,包括宿舍建筑、公寓建筑、办公建筑、科研建筑、文化建筑、商业建筑、体育建筑、医疗建筑、交通建筑、旅游建筑、通信建筑等。

(三)业主,是指高层建筑的所有权人,包括单位和个人。

(四)使用人,是指高层建筑的承租人和其他实际使用人,包括单位和个人。

Article 60 The meaning of the following terms in the Provisions:

(1)High-rise residential buildings refer to residential buildings with a building of height more than 27 meters.

(2)High-rise public buildings refer to non-story public buildings with a building height of more than 24 meters, including dormitory buildings, apartment buildings, office buildings, scientific research buildings, cultural buildings, commercial buildings, sports buildings, medical buildings, transportation buildings, tourism buildings, communication buildings, etc.

(3)An owner refers to the person who has the ownership of a high-rise building, including entities and individuals.

(4)A user refers to the lessee and other actual users of high-rise buildings, including entities and individuals.


第六十一条本规定自202321日起施行。天津市人民政府201428日公布的《天津市高层建筑消防安全管理规定》(2014年市人民政府令第6号)同时废止。

Article 61 These Provisionscome into force as ofFebruary 1, 2023. Provisions of Tianjin fire safety management of High-rise Buildings(No. 6 of the Decree ofTianjin Municipal People’s Government in 2014) promulgated by Tianjin Municipal People’s Government on February 8, 2014, shall be repealed simultaneously.
